          寧波房屋征收補償草案:九成同意才能啟動改建

          今年9月底,《浙江省國有土地上房屋征收與補償條例》正式施行,許多房屋征收引發的利益沖突和矛盾糾紛在制度上得到瞭緩解。對此,很多寧波市民希望:本地的征收補償政策能早日出安全來。

          寧波市政府、寧波市住建委安全等相關門戶網站近日全文公佈《寧波市國有土地上房屋征收與補償辦法草案征求意見稿》(下簡稱《草案》),面向社會征集意見。

          舊城區改建與否,誰說瞭算?

          90%以上被征收人同意改建才行

          與省裡的條例類似,寧波的這份《草案》特別提到瞭舊城區改建征收項目。

          以後,舊城區改建與否安全,房屋征收部門應當組織征詢房屋征收范圍內所有被征收房屋所有權人的改建意願,其中至少要90%以上被征收人同意改建。

          在舊城區改建征收房屋中,如果50%以上的被征收人提出征收補償方案不符合《國有土地上房屋征收與補償條例》、《浙江省國有土地上房屋征收與補償條例》和本辦法規定的,市或者縣(市、區)人衛生民政府應當公開舉行由被征收人代表和公眾代表參加的聽證會,形成聽證報告。

          補償協議生衛生效,有啥條件?

          達到80%以上的規定簽約比例

          舊城區改建征收房屋,房屋征收部門還應當與被征收人簽訂附生效條件的補償協議。

          在簽約期限內達到80%以上的規定簽約比例的,補償協議生效;未達到80%以上的規定簽約比例的,補償協議不生效,房屋衛生征收決定效力終止。對不屬於房改食品出售范圍的公有住房承租人因房屋征收已辦理房改審批手續的,審批效力同時終止。 衛生
